SumpWatch Terms of Service

These Terms are an agreement between you and Gino Tech LLC ("Gino Tech", "we", "us") for the SumpWatch devices, mobile app and online service (together, "SumpWatch"). By creating an account or using SumpWatch, you agree to these Terms. If you do not agree, do not use SumpWatch.

1. SumpWatch is a monitoring system only

SumpWatch monitors the water level in your sump pit and sends notifications. It does not pump water, prevent flooding, or protect your home or property from water damage. SumpWatch is not a substitute for a working sump pump, a backup pump, a battery backup, regular maintenance, insurance, or a professionally monitored alarm service.

Gino Tech is not responsible for any flooding, water damage, mold, or other damage to your basement, home, belongings or property, or for any related costs, whether or not SumpWatch detected the water or sent an alert. You remain fully responsible for your sump pump, your home and your property.

2. Alerts are not guaranteed

SumpWatch depends on things outside our control, including electrical power, your home Wi-Fi and internet service, cellular service, Apple’s and other providers’ notification services, your phone’s settings, and the condition and installation of the sensors. Alerts may be delayed, may not be delivered, or may not be sent at all. A power outage, a Wi-Fi or internet outage, a phone set to silent or Do Not Disturb, notifications turned off, or a sensor that is stuck, dirty or installed incorrectly can each prevent an alert. Do not rely on SumpWatch as your only way of knowing about water in your home.

3. Your responsibilities

You agree to:

  • install the controller, floats and any camera as described in our instructions, and test the system after installing it and regularly afterwards (for example with Settings → Send a test alert and by lifting the floats);

  • keep the device powered and connected to Wi-Fi, keep notifications turned on for the SumpWatch app, and keep the app up to date;

  • maintain your sump pump and any backup equipment;

  • respond to alerts promptly, and call a plumber, emergency services or other help when needed;

  • keep your account password private, and only share access with people you trust;

  • use SumpWatch only for lawful purposes, and not to copy, reverse engineer, disrupt or misuse the service.

4. Sharing access

You can invite other people to see your SumpWatch and get its alerts. Anyone you invite can view its status, history and photos and can control the pit light. You are responsible for whom you invite, and you can remove them at any time.

5. Your account

You must be at least 18 years old to create an account. You can delete your account at any time in the app. We may suspend or end your access if you break these Terms or misuse the service. We may change or stop parts of the service; if we stop the service entirely, we will try to give you reasonable notice.

6. Disclaimer of warranties

TO THE FULLEST EXTENT ALLOWED BY LAW, SUMPWATCH IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SUMPWATCH WILL DETECT EVERY WATER CONDITION, THAT ALERTS WILL BE SENT OR DELIVERED, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. Any warranty that comes with the physical SumpWatch device is described in its product warranty and is not expanded by these Terms.

7. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, GINO TECH AND ITS OWNERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY PROPERTY DAMAGE, WATER OR FLOOD DAMAGE, MOLD, LOSS OF USE, PERSONAL INJURY, OR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING FROM OR RELATED TO SUMPWATCH OR ANY FAILURE OF SUMPWATCH TO DETECT WATER OR SEND AN ALERT, EVEN IF WE WERE TOLD SUCH DAMAGE WAS POSSIBLE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO SUMPWATCH IS LIMITED TO THE AMOUNT YOU PAID FOR SUMPWATCH IN THE 12 MONTHS BEFORE THE CLAIM. Some states do not allow certain limits on liability, so some of these limits may not apply to you.

8. Indemnity

You agree to cover Gino Tech’s losses and costs (including reasonable legal fees) from claims by others that arise from your misuse of SumpWatch or your breach of these Terms.

9. Apple App Store

If you downloaded the app from the Apple App Store, these Terms are between you and Gino Tech, not Apple. Apple is not responsible for the app or its support, and has no warranty obligation for it beyond refunding the purchase price, if any. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

10. Changes to these Terms

We may update these Terms. We will post changes on this page and update the effective date, and tell you in the app or by email if a change is significant. Continuing to use SumpWatch after a change means you accept it.

11. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Erie County, New York, unless the law where you live requires otherwise.
